Mercer Island HS marching band heads to Pasadena for Rose Parade

SEATAC, Wash. -- The Mercer Island High School marching band headed for southern California to perform in the 2012 Rose Parade this weekend.

Band members left on two separate flights from Sea-Tac Airport Wednesday morning for Pasadena. Members have been practicing for weeks and say they're thrilled about their trip.

"We're looking forward to it. It's gonna be a real good time and it's gonna be a lot of work, but it will pay off in the end," said Sean Quinn, sophmore.

"This is huge for our band program. Everyone is really excited for this," said Alex Mesher, band president. "It has made our band program stronger than it has ever been before."

The Mercer Island High School marching band is the only band from Washington state in this weekend's Rose Parade.

Galaxy sign midfielder Villarreal

Carson, CA (My Sportsbook) - The Los Angeles Galaxy signed 18-year-old midfielder Jose Villarreal as a Homegrown Player on Thursday.

Villarreal is the third player to be signed directly from the Galaxy Academy, joining Tristan Bowen and Jack McBean.

"Jose is a player that we have known and watched for a long time and it's been great to have him in our Academy this past year," said Galaxy Academy Senior Director Chris Klein. "He has a tremendous amount of promise and potential and we're excited that he'll be able to continue his development with the first team."

Villarreal has represented the United States at various youth levels.

"It's been my dream ever since I was little to be a professional soccer player, so to be able to do that and stay close to home so that I can play in front of my family and friends is a dream come true," Villarreal said.

"Growing up here in the area I've always watched the Galaxy and been a fan of the team so this will be a great experience for me."

Apple Italia has been fined a total of 900,000 euros for failing to inform its customers that products purchased were already covered by two years of free assistance under national law. It appears that Apple employees encouraged the extra purchase of its own AppleCare plans. With the European court's continued investigation of possible e-book price-fixing and ongoing legal jousting with Samsung unlikely to end any time soon, it looks like Apple will be busy in the courts next year too.

FBI shooting range is popular deer hangout (AP)

QUANTICO, Va. ? Call it a playground for Bambi and G-Men, where imaginary criminals are hunted and deer are the spectators.

The 547-acre FBI Academy, where some of the nation's best marksmen fire off more than 1 million bullets every month, happens to be one of the safest places for deer during hunting season.

The property on the Marine Corps base in Quantico, Va., is home to some of the FBI's most elite forces and training programs as well as a de facto wildlife refuge where deer, fox, wild turkeys, groundhogs and vultures roam fearless and free.

In recent years, a black bear was spotted running across a parking lot, and a groundhog cornered an FBI agent coming out of the cafeteria, hoping to score some human food, FBI spokesman Kurt Crawford said. Turkey vultures are often seen perched atop the 500,000-square-foot national crime lab where the FBI analyzes evidence, including the remains of the former al-Qaida leader in Iraq.

The wild animals are as much a fixture at the academy as the hostage rescue team and criminal profilers.

The most common furry friends on the sprawling campus some 30 miles outside Washington are the deer, a regular at the shooting ranges, driving courses and physical training trails.

On a December afternoon, deer grazed above one of the academy's 16 practice shooting ranges. They stood just 15 feet away from the paper targets. Nearby, shots popped loudly from a Colt M4 Carbine rifle, and the white-tailed deer did not flinch.

"They're pretty immune to the sound," said Sean Boyle, supervisory special agent bomb technician and principal firearms instructor for the Critical Incident Response Group based at the academy. The deer typically graze on top of the berm, about 15 feet away from the targets and rarely go directly in the line of fire. Boyle said he doesn't recall an instance where a deer was shot accidentally.

"It's like they think, `We've pushed the limit for this far, and all our generations have pushed the limit for this far,'" Boyle said. "They're just so docile around here. They don't know what a gun is."

The Virginia Department of Game and Inland Fisheries does not keep direct tabs on the deer population at the FBI academy, but a spokeswoman said statewide the deer population has remained about the same over the past decade, partly because of regulated hunting. Licensed deer hunters are allowed on parts of the Marine Corps base but not at the academy where the FBI does not hunt its animals.

At the FBI Academy, the deer have even become part of the training in some of the driving courses, said Tim Moles, the supervisory special agent who oversees the Tactical and Emergency Vehicle Operations Center, where recruits learn to avoid crashing their cars and conduct surveillance without being spotted. The deer are convenient when recruits learn to avoid collisions, Moles said. "There's times when it seems like they're playing chicken with us," Moles said. "We respect them because they can do damage. We'd rather avoid all deer stories in this end of the academy."

For the most part, the deer have stayed out of trouble. Twice, however, deer have eaten freshly-planted pansies at the academy's 9/11 memorial courtyard, Crawford said. Eventually a fence was built to keep the flowers off limits.

Deer have been known to interrupt physical training, too.

"We've had the deer walk across the middle of the track during the 300-meter sprint," said Susann Dreiling, unit chief of the academy's physical training unit.

To become an agent, recruits must pass a physical fitness test. They are scored on how fast they can run and how many push-ups and sit-ups they perform. Sometimes, training will involve running a quarter-mile path along the lake area of the academy, stopping for push-ups, running some more and breaking to box, Dreiling said.

During these exercises, a mother and her fawns are often close by.

"They just stand there and watch as if they're evaluating them," Dreiling said, "just like the instructors are."

Daniel Solove (George Washington) has issued a call for book reviews (here and here) of new Oxford University Press books to be published on Concurring Opinions.? Two of the books are about tax:

In The Oxford Introductions to U.S. Law: Income Tax Law, Edward McCaffery presents an accessible introduction to the major topics in the field of federal income taxation, such as income, deductions, and recognition of gains and losses. OUR VIEW: Merry Christmas to our wonderful community

The staff of the Campbell River Mirror would like to wish all our readers a Merry Christmas.

As a community, we?ve come through a tough economic stretch and instead of bringing us all down, all signs indicate that we?re at least as appreciative of what we have living in this beautiful community as we?ve ever been.

We?ve also proven that economic difficulties make us no less generous than we?ve been in prosperous times. That?s a testament to the character of our community. We haven?t forgotten our less fortunate.

And of course, when we talk about community, that includes not only the city but the rural residents of this wonderful corner of the world. Christmas is a time of year when we take stock of what we value and who we want to be as individuals and as a community.

It?s the nature of the Christian-based traditions of the celebration to reflect on being the best we can be. It?s a characteristic of all religions and is a sentiment that people of all faiths ? and people of no faith ? can support. One of this community?s enduring characteristics is its willingness to strive for tolerance and appreciation of diversity. It?s a gift we can give ourselves.

As a predominantly Christian community, the majority of Campbell River area residents throw themselves into the seasonal celebration with as much gusto as anyone. And it must seem overwhelming to those who don?t subscribe to all of the traditions involved but this town likes to party so there?s no holding us back. The cynics come out at this time of the year as much as anybody but most of us are willing to give one part of the year over to celebrating higher human values. Who can argue with that?

So, Merry Christmas to all our readers and customers. Celebrate the great gift of life in a wonderful community.

'Teen Mom 2: After Show': What Teen Moms Wish They Knew Before They Got Pregnant (VIDEO)

The idea behind "Teen Mom" and "Teen Mom 2" was for them to serve as cautionary tales to teenagers that teen pregnancy and parenthood is far more difficult than most young people can imagine. Parents and teachers and other adults say it all the time, but the message doesn't seem to get through.

On the "Teen Mom 2: After Show" (Tue., 11 p.m. ET on MTV), SuChin Pak sat down with the girls to ask them what they wish they'd known before they got pregnant. The answers were exactly what was expected, because hindsight brings the same wisdom that the adults have been trying to impart for years.

Kailyn Lowry wished she could have known how time consuming a baby is, and "how hard it is to focus on everything else you have going on in your life besides having a baby." For Jenelle Evans it was missing out on sleep and hanging out with friends ... in other words, missing out on being a typical teenager.

"For me I wish I would have appreciated more of being a child," Leah Messer said. "'Cause now that it's gone, it's like gone in a flash."

Royal Dutch Shell Reports Oil Spill of Nigerian Coast

Royal Dutch Shell's Nigerian division said it shut down an offshore drilling platform because of a leak involving transfer of oil to a shipping tanker.

"The company can confirm it is responding to an oil leak at the 200,000 barrel-per-day capacity Bonga deepwater facility, approximately 120 kilometers off the Nigeria coast. The leak occurred Tuesday, Dec. 20, during a routine operation to transfer crude oil from Bonga's floating production, storage and off-loading vessel to a waiting oil tanker," the company said in a statement.

"An export line linking the FPSO to the tanker has been identified as the likely source," Shell said.

The Daily Vanguard in Nigeria reported Friday Shell stands to lose $21.47 million daily based on the current price of $107.38 for Brent oil.

Shell said it responded quickly as the leak was discovered and "early indications show that less than 40,000 barrels of oil have leaked in total."

Also on Friday, the Nation reported Shell Nigeria Exploration and Production Co.'s Oil Spill Response Procedure and Emergency Response Team was called in to manage the spill.

This week, the Pentagon marked the official end to the war in Iraq with a brief ceremony in a secure part of the Baghdad airport -- helicopters hovering protectively overhead. Although Defense Secretary Leon Panetta later declared that the cost paid by America was "worth it," a look at the price tag offers a more sobering assessment: 4,487 U.S. military personnel killed, over 2,000 U.S. government contractors killed, over 40,000 American troops wounded, over 100,000 Iraqis killed, at least 2 million Iraqis displaced from their homes, and a final tab that could ultimately reach $4 trillion doled out by U.S. taxpayers (a far cry from the $50 billion to $80 billion the Defense Department originally predicted it would cost). And beyond the cost in lives and treasure are the less quantifiable costs we'll be paying for years to come, including the strengthening of Iran and the weakening of America's moral standing in the world.

Israeli lawmakers move to annex West Bank, one museum at a time (The Christian Science Monitor)

Kedumim, West Bank ? As Rachel Slonim shows a visitor around the modest, unheated archeological museum in this West Bank settlement, she becomes animated when she reaches a display case with artifacts from the biblical Israelite period.

''The Israelite period was the most beautiful period in the history of Samaria,'' says Ms. Slonim, referring to the 600-year era that she says climaxed with the reign of King Omri, who built his capital near the area where she lives today. ''Settlement is very important in our eyes and the eyes of the Holy One Blessed Be He, who gave us this land.''

Slonim and her husband, Zvi, who helped found the Kedumim settlement more than three decades ago, are among more than 300,000 Israelis with homes outside the borders of Israel proper. Technically they live under military rule, established after Israel conquered the West Bank in the 1967 war.

But the trappings of civilian Israeli government and the implied annexation that comes with it have been accumulating in the area in recent years. Now a new bill in Israel's parliament would give unusually high-profile endorsement for the expansion of Israeli government in the disputed territory, which settlers see as the biblical cradle of Jewish civilization but Palestinians consider to be the heartland of their future state.

Legislator Uri Ariel of the far-right National Union party says the first step, outlined in this bill, would be securing government funding for museums in settlements, like the one in Kadumim. With backing from Israeli Culture Minister Limor Livnat, of Prime Minister Benjamin Netanyahu's Likud party, the bill passed its first reading last week and looks likely to become law.

While the bill itself appears modest, critics say it amounts to declaring an annexation policy that boosts right-wing settlers and their supporters at the expense of Palestinians and Israelis who are uncomfortable with the notion that the West Bank ? and its majority Palestinian population ? will become part of Israel someday.

''The policy has been to continue Israeli rule and extend Israeli law in bits and pieces, gradually to Israelis living in the West Bank while keeping Palestinians living under military occupation or a mix of military occupation and Palestinian Authority autonomous rule,'' says Gershom Gorenberg, a prominent historian of the settler movement. He says what is new about Mr. Ariel's bill is that the annexing is being done brazenly.

''He is saying, I don't want to do it like thieves in the night, I want to do it publicly, I'm proud of this. Ariel wants public recognition of what he is doing," says Mr. Gorenberg, author of The Unmaking of Israel. "The goal is to take the long process of applying Knesset [parliamentary] legislation and military orders to settlers, which blurs Israel's borders and who lives in Israel and who doesn't, and make it a declared policy.''

Palestinian legislator Hanan Ashrawi termed the museum bill ''the death knell of any chances of peace.''

''It is ensuring that settlements remain part of Israel and it exposes a very dangerous policy,'' she added. ''Israel keeps talking about a two state solution, but in reality, it is working for a one state solution.''

Equality for settlersAriel says the bill is needed to ensure that the right to culture of settlers is equal to that of other Israelis, something he says has not been the case until now. ''First of all there will be equality,'' he says. ''They can get orderly budgets and it will definitely bring more visitors, more culture, more everything."

If approved, the bill would make museums in the settlements eligible for the first time to apply for a share of the 40 million shekels ($10.5 million) in government funding currently allocated only to museums inside Israel proper.

Slonim, who works on a voluntary basis and is nearly an octogenarian, says the bill could enable the hiring of a salaried successor to her as guide and curator.

''I hope this law will help us to do things we could only dream about,'' including seminars on archeological preservation and the holding of temporary exhibits, she says.

The museum displays mostly objects garnered from excavations at Kedumim, located near the Palestinian city of Nablus, as well as some finds from elsewhere in the vicinity. There are also displays aimed at making the link to modern Israel, with one of them showing David Ben-Gurion's declaration of the state in 1948.

Poetry books of the late right-wing writer and politician Moshe Shamir ? a founder of the Whole Land of Israel movement, which lobbied for settling the West Bank after its capture ? are on sale and there is a display of posters, including one from before Israel's establishment, of a muscular man with a shovel. ''Help him build Palestine,'' it says in Hebrew.

What's different this timeBut Ariel, and critics, say the law is not just about the museums, but rather about applying Knesset legislation to the settlers, despite their being beyond Israel's internationally recognized boundaries.

In a departure from past practice where the intent to apply Israeli law in the West Bank is buried in the text, if mentioned at all, Ariel says he has this time put it in the title of a bill. Indeed, the bill is called ''The Museums Proposed Law (Amendment-Application of the Law to Judea and Samaria).''

''There are other laws that apply in Judea and Samaria, but this one is outstanding in the sense that it is right there in the name. This is a bit of an innovation,'' Ariel says. He added that he intends to do the same thing in the future with further bills addressing realms where Israeli law is not being applied to settlers, but declined to specify those topics.

In his Knesset remarks, Ariel said the museum law ''constitutes the realization of the voters desire to strengthen settlement and Israeli sovereignty in Judea and Samaria,'' using the biblical names for the West Bank.

Decades-old debate In a sense, the application of Knesset law to the settlers is almost as old as the occupation itself.

While in the immediate aftermath of Israel's stunning victory in the 1967 Six-Day War, Theodor Meron, the legal counsel of the Israeli foreign ministry, advised the government that it was illegal to settle civilians in occupied territory, he was disregarded. (The Fourth Geneva Convention of 1949 bars an occupying power from transferring its citizens into the occupied territory.)

A month after the war ended, a military order was issued in July 1967 specifying that Israelis who committed offenses in the West Bank could be tried in Israel as if the offense was committed in Israel.

This order has been re-ratified by the Knesset at various intervals ever since, with riders tacked on, including that Israelis can register nonprofit organizations in settlements, that settlement residents would have the same tax obligations as other Israelis, and that Israel's National Health Insurance Law applies to Israeli residents of settlements.

In Kadumim, Slonim harkens back to King Omri, casting him as a hero for his settlement efforts even though scripture says he "was evil in the sight of the Lord and dealt wickedly above all that were before him."

"He was an idol worshiper, but he engaged in settling the land of Israel so his other sins are forgiven," she says.

APNewsBreak: Satellite gets pic of Chinese carrier (AP)

DENVER ? A commercial U.S. satellite company said it has captured a photo of China's first aircraft carrier in the Yellow Sea off the Chinese coast.

DigitalGlobe Inc. said Wednesday one of its satellites photographed the carrier on Dec. 8. A DigitalGlobe analyst found the image on Tuesday while searching through photos.

Stephen Wood, director of DigitalGlobe's analysis center, said he's confident the ship is the Chinese carrier because of the location and date of the photo. The carrier was on its second round of sea trials at the time.

A Pentagon spokesman didn't immediately respond to a request for comment.

DigitalGlobe, based in Longmont, Colo., sells satellite imagery and analysis to clients that include the U.S. military, emergency response agencies and private companies. DigitalGlobe has three orbiting satellites and a fourth is under construction.

The aircraft carrier has generated intense international interest because of what it might portend about China's intentions as a military power.

The former Soviet Union started building the carrier, which it called the Varyag, but never finished it. When the Soviet Union collapsed, it ended up in the hands of Ukraine, a former Soviet republic.

China bought the ship from Ukraine in 1998 and spent years refurbishing it. It had no engines, weaponry or navigation systems when China acquired it.

China has said the carrier is intended for research and training, which has led to speculation that it plans to build future copies.

Beijing is believed to be years away from being able to launch and recover aircraft from it as part of a carrier battle group.

Rapper Flo Rida enters deal after DUI arrest

Rapper Flo Rida has entered into a deal for first time offenders on his DUI arrest on Miami Beach.

His attorney told the Miami Herald Wednesday the singer will enroll in the "Back on Track" program which requires him to perform community service and take DUI classes.

If completed, Flo Rida will have his DUI charge amended to reckless driving.

His arrest report says officers spotted his car driving erratically about 3:45 a.m. on June 6. The report says the rapper, whose real name is Tramar Dillard, failed a field sobriety test. It also says he blew twice the legal limit to drive into a device to measure his blood-alcohol level, had bloodshot, watery eyes, and slurred speech.

Flo Rida's hits include the party jam "Low" and "Right Round."

AT&T mulling whether, how to revise T-Mobile deal (Reuters)

NEW YORK (Reuters) ? AT&T Inc has another month to decide whether it wants to continue to pursue its $39 billion acquisition of T-Mobile USA after a U.S. Judge agreed to delay the court battle over the deal until January 18.

AT&T had originally been due in court on Thursday in the case brought by the U.S. Department of Justice, which opposed the deal on concerns it would harm competition in the U.S. wireless market by combining the No. 2 and No. 4 players.

Many experts consider the deal to be doomed but AT&T and T-Mobile USA's parent Deutsche Telekom had until Monday been adamant, at least publicly, that they would continue to fight for approval of the merger announced in March. On Monday however, AT&T raised the possibility that it may have to restructure the deal.

"We are actively considering whether and how to revise our current transaction to achieve the necessary regulatory approvals," AT&T said in a statement.

In granting the stay of the proceeding on Monday, Judge Ellen Huvelle also ordered AT&T and T-Mobile USA to tell the court by noon January 12 whether they plan to continue to pursue their agreed deal or an amended one and to give an update on their plans for seeking necessary approval from the U.S. telecommunications Federal Communications Commission.

After the FCC voiced objections to the deal last month, AT&T withdrew its application with the U.S. telecommunications regulator and said it would take a $4 billion charge to cover a break-up fee it agreed to pay T-Mobile USA in case the deal fell apart.

The request for a court delay was in contrast to AT&T's previous position as it had asked the court for an expedited trial for fear that T-Mobile USA's business would deteriorate during an extended court fight.

Stifel Nicolaus analysts said that AT&T likely only agreed to seek a stay on the case as a compromise to avoid having the DoJ push to dismiss the case.

Regulatory experts said the stay did not indicate any improvement in AT&T's prospects for a settlement with the DoJ.

"I don't think they're in discussions to settle," said Bert Foer, head of the American Antitrust Institute who added that AT&T may just be renegotiating the breakup fee it agreed to pay T-Mobile USA in the event of a regulatory block of the deal.

"I think it's dead. I can't see where AT&T has any particular benefit in litigating at this point," Foer said.

The joint motion "means that the deal is suffering the death by a thousand cuts," said Evan Stewart, an antitrust expert at the law firm Zuckerman, Spaeder LLP.

Other experts were skeptical AT&T can succeed in getting any kind of deal with T-Mobile USA approved.

"I think the deal as originally conceived is surely undone," said Andrew Gavil, an anti-trust expert at Howard University's School of Law.

"What remains to be seen is whether AT&T and Deutsche Telecom can construct any kind of alternative ... It seems like they would have done so by now, however, if there was an alternative that could satisfy the DOJ and still make business sense," he said.

Both the Justice Department and the FCC objected to the deal on the grounds that it would hurt competition in the U.S. wireless market. The purchase of No. 4 U.S. mobile operator T-Mobile USA would vault No. 2-ranked AT&T into first place in the U.S. market.

Sprint Nextel, the No. 3 U.S. mobile service has been fighting to block the deal.

Japan's Olympus hid up to $1.7 billion, no proof of yakuza (Reuters)

TOKYO (Reuters) ? An investigative panel has found Japan's disgraced Olympus Corp hid up to $1.67 billion in losses from its investors, but is likely to say there is no evidence of involvement by organized crime in the cover-up, a source said Monday.

The panel will also stop short of recommending criminal charges against executives involved in the accounting scandal, presenting only the facts and leaving Olympus to pursue this aspect, said the source familiar with the panel investigation.

"That is up to the company," he said.

The panel's report is due to be released as soon as Tuesday, almost two months after Olympus's sacked chief executive, Englishman Michael Woodford, went public with his concerns over its dubious accounting for a series of murky acquisitions.

The maker of cameras and medical equipment has since lost more than half its market value and risks being delisted from the Tokyo stock exchange, a sanction that would cut it off from equity markets and put it under pressure to sell core assets.

But it may be able to avoid that humiliation if there is no proof of the much-rumored link between the cover-up and Japan's "yakuza" gangsters -- and if Olympus can meet a December 14 deadline to iron out its books and report its second-quarter results.

Olympus shares firmed 3 percent on the news, though investors remain on tenterhooks for not only the panel's official findings but also the outcome of a separate, joint investigation by police, prosecutors and the market regulator.

The source said the panel found that former executive vice president Hisashi Mori and ex-internal auditor Hideo Yamada had led the cover-up of losses, which amounted to 130 billion yen ($1.67 billion) at its peak.

The panel has found Mori and Yamada then informed former president Tsuyoshi Kikukawa, the source added. Kikukawa at first publicly rejected the accusations of a cover-up when the scandal broke in October, but he later quit and the company conceded it had hid investment losses stretching back as far as two decades.

CRIMINAL COMPLAINTS

Current President Shuichi Takayama has said the firm is prepared to take legal steps, including filing criminal complaints, against those responsible for the cover-up.

Olympus has so far said that it used some of $1.3 billion in acquisition payments and advisory fees to aid in the cover-up of the losses on its securities investments. It has declined to give details until the panel hands down its report.

The panel was appointed by Olympus and includes a former supreme court judge.

Olympus remains under joint investigation by Tokyo police, prosecutors and the Securities and Exchange Surveillance Commission. The official investigations include a police unit dedicated to fighting organized crime.

The Tokyo Stock Exchange has placed Olympus on a watch-list as a possible prelude to delisting. Even if the firm meets the December 14 reporting deadline, the exchange can still delist the stock depending on the scale of its past misreporting or if it is found to have knowingly done business with organized crime.

Woodford, who blew the whistle on accounting tricks at the company after his sacking from the top job in October, has launched a campaign to oust the current board and replace it with his own team of candidates led by him as nominated CEO.

That has set up a battle between Woodford, who was a rare foreign CEO in Japan, and Takayama, who plans to stay on, at least in the short term, to try to get the firm back on track.

The Olympus affair has fanned doubts about corporate governance generally in Japan as well as revived concerns about ties between yakuza and companies. Yakuza have a long history of trying to extort money from companies, sometimes threatening to release information that firms would like to keep secret.

Attention will also focus on the panel's findings over the role of auditors who signed off on Olympus' books, as well as outsiders such as Akio Nakagawa, a banker with lengthy ties to Olympus and whose firm Axes received a huge advisory fee related to the 2008 takeover of UK medical equipment maker Gyrus.

Augmented Sound Gaming With Dimensions ? 148Apps ? iPhone ...

Making everyday life a game.

Technology is improving in in leaps and bounds. It?s an immensely exciting time to be alive. Just a glance at the growing prevelance of Augmented Reality games aptly demonstrates that. How about a game that relies on augmented sound though? Now, that?s a bit different.

Dimensions looks extremely interesting in that respect. It uses augmented sound to turn the world into a game. Designed to be played in parallel with normal life, the game manipulates and enhances sound nearby changing the things we hear as a matter of course over the day. Players enter and exit different dimensions within the game as they go about their life. Missions can then be completed by collecting artifacts and fighting enemies.

It?s a pretty fascinating concept and with music from Inception composer Hans Zimmer, Dimensions looks all the more compelling.

Dimensions is set for release sometime this month. We?ll be sure to keep an eye on its development. For now, check out the video below that explains a bit more.

MIAMI (AP) ? A feud has erupted within the first family of reggae, with the widow and nine children of Bob Marley suing his half brother to stop use of the Marley name to promote an annual Miami music festival and profit from other businesses in his native Jamaica.

The lawsuit filed Thursday in federal court contends the half brother, businessman Richard Booker, and several affiliated companies are violating copyright and trademark laws by using Marley's name, photographs, lyrics, symbols and other intellectual property without authorization.

The lawsuit says people could be deceived into thinking those uses are officially endorsed by Marley's widow, Rita Marley, and their children. Booker and Bob Marley shared the same mother.

The entities include the Bob Marley Movement of Jah People Inc., which promotes the music festival, a restaurant in Jamaica called Mama Marley's and several businesses with the name Nine Mile ? the part of Jamaica where Marley grew up and is now buried. One Nine Mile business offers a tour of the area, and the music event is known as the Nine Mile Music Festival.

In addition, a recent press release about the music festival included this headline: "All For The Love Of Bob Marley." The 19th annual festival is scheduled for March of next year on Virginia Key, near Miami. Three of Marley's kids ? Stephen, Damien and Julian Marley ? are scheduled to perform.

Marley, a member of the Rock and Roll Hall of Fame, died of cancer in 1981 at age 36. Some of his best-known songs are "I Shot The Sheriff," ''Jamming," ''No Woman, No Cry," ''Get Up, Stand Up" and "Exodus."

The lawsuit, filed by Fort Lauderdale attorney Bruce Hemerlee, seeks unspecified damages and also asks a judge to stop Booker and the companies from using any Marley-related references in the various ventures. Hemerlee represents Rita Marley and the children through a Bahamas-based entity called Fifty-Six Hope Road Music Ltd.

Booker, whose home and businesses are in Miami, did not immediately return a telephone call Friday seeking comment. A spokeswoman at his business said a statement may be issued later.

According to the festival's website, the event's roots date to a Bob Marley fan club begun in 1981. That gradually grew into the music festival and related food drive that has collected more than 2 million canned goods for shelters in Miami and Jamaica.

The lawsuit says that Rita Marley and her children have long opposed Booker's attempts to trademark Marley-related business names and that at one point they reached a licensing deal, but Booker reneged on the deal.
